Terms of service
Last updated: August 21, 2026
These Terms of Service (the "Terms") govern your access to and use of the website located at ashfordcrowe.com and any related services, content, and features (together, the "Site"), operated by Ashford & Crowe, trading as Ashford & Crowe ("we", "us", or "our"). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of the Terms
By visiting the Site, browsing our products, creating an account, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms, together with our Privacy Policy, Shipping Policy, and Refund and Return Policy, each of which is incorporated by reference. If you do not agree with any part of these Terms, you must not use the Site or place an order.
We may reference additional guidelines, policies, or rules on specific pages of the Site. Those additional terms form part of your agreement with us whenever you use the relevant part of the Site.
2. Eligibility and Minimum Age
- You must be at least 18 years of age, or the age of legal majority in your country or region of residence, to place an order.
- If you are between the applicable minimum age and the age of majority, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
- By using the Site, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.
- You may not use the Site or our products for any illegal or unauthorized purpose, and you must comply with all laws that apply to you, including the laws of Worldwide and the laws of your own jurisdiction regarding the import of goods.
3. Account Responsibilities
You may be able to create an account to make shopping easier. When you create an account, you agree to:
- Provide accurate, current, and complete information, and keep it up to date.
- Keep your login credentials confidential and not share them with any third party.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at support@ashfordcrowe.com if you suspect any unauthorized access to or use of your account.
We reserve the right to suspend or terminate your account, refuse service, or cancel orders if we reasonably believe that the information provided is false, that the account has been used in breach of these Terms, or that use of the account may harm us, other customers, or third parties.
4. Products, Pricing, and Availability
We sell and ship products worldwide. Some products offered on the Site may be sourced from and shipped directly by third-party suppliers under a fulfilment (dropshipping) model. This may affect processing times, packaging, and delivery estimates, as described in our Shipping Policy.
- Prices. Unless stated otherwise, all prices are shown in your local currency and are exclusive of any taxes, duties, customs charges, or shipping fees unless expressly indicated at checkout. The total payable, including any applicable shipping and taxes shown to you, will be displayed before you confirm your order.
- Right to change prices. We may change prices, product offerings, and promotions at any time and without prior notice. The price that applies to your order is the price displayed at the time your order is confirmed, except in the case of an obvious pricing error as described below.
- Availability. All products are subject to availability. We may limit the quantity of any product, discontinue a product, or restrict sales to any person, geographic region, or jurisdiction at our discretion.
- Colours and descriptions. We make reasonable efforts to display product images, colours, and descriptions as accurately as possible. However, we cannot guarantee that your device will display colours accurately, and actual products may vary slightly from the images shown. Product descriptions, specifications, dimensions, and weights are provided as a guide and may contain approximations.
- Errors. Despite our efforts, products may occasionally be listed with an incorrect price, description, or availability. If we discover an error affecting a product in your order, we may cancel or correct the order and, where you have already paid, refund the amount charged. We are not obliged to fulfil an order based on an obvious error.
5. Orders and Our Right to Accept, Cancel, or Refuse
When you place an order, you are making an offer to purchase the products in your cart, subject to these Terms. Any order confirmation email or message is an acknowledgement that we have received your order, not an acceptance of it.
- A binding contract is formed only when we confirm that your order has been accepted or dispatched.
- We reserve the right to accept, decline, cancel, or limit any order in whole or in part at our discretion, including where products are unavailable, where we suspect fraud or unauthorized activity, where a pricing or product error has occurred, or where we are unable to ship to your location.
- If we cancel an order after you have been charged, we will refund the amount paid for the cancelled items using the original payment method.
- You may request a change or cancellation of an order before it has been processed or dispatched by contacting us promptly at support@ashfordcrowe.com. Once an order has entered processing or fulfilment, we may be unable to modify or cancel it.
6. Payment
- Payment is due in full at the time you place your order, unless a different arrangement is expressly offered at checkout.
- We accept the payment methods displayed on the Site. All payments are processed by third-party payment providers, and by paying you also agree to their terms.
- You represent that you are authorized to use the payment method you provide and that the billing information you supply is true, accurate, and complete.
- Prices are charged in your local currency. If your payment method is denominated in another currency, your bank or provider may apply conversion rates and fees for which we are not responsible.
- You are responsible for any import duties, taxes, or customs charges that may apply on delivery to your country. These charges are set by your local authorities and are not included in our prices unless stated.
7. Promotions and Discount Codes
- Promotions, sales, coupons, and discount codes are offered at our discretion and may be subject to additional conditions stated at the time of the offer.
- Unless stated otherwise, discount codes cannot be combined with other offers, have no cash value, are non-transferable, and may not be applied retroactively to previous orders.
- Each promotion may have an expiry date, a minimum purchase requirement, product exclusions, or usage limits.
- We reserve the right to modify, suspend, or cancel any promotion, and to refuse or void a discount where we reasonably suspect misuse, error, fraud, or breach of these Terms.
8. Shipping and Returns
Delivery timeframes, shipping costs, and fulfilment arrangements (including products shipped directly by third-party suppliers) are described in our Shipping Policy. As a general guide, orders are prepared within 1 to 3 business days, with estimated delivery of 3 to 7 business days for domestic orders and 7 to 20 business days for international orders. All timeframes are estimates and are not guaranteed.
Returns, exchanges, and refunds are governed by our Refund and Return Policy. In general, eligible items may be returned within 30 days, and approved refunds are processed within 5 to 10 business days. Please review those policies for full details, conditions, and any exclusions.
Risk of loss and title for products pass to you when your order is delivered to the address you provide or, where a signature or collection is required, when the order is made available for collection, matching the "Failed Delivery and Risk of Loss" section of our Shipping Policy, unless the laws that apply to you as a consumer provide otherwise.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, product descriptions, photographs, videos, page layouts, and software, is the property of Ashford & Crowe, Ashford & Crowe, or our licensors, and is protected by copyright, trademark, and other intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes.
- You may not copy, reproduce, republish, distribute, modify, sell, or exploit any part of the Site or its content without our prior written permission.
- All trademarks, service marks, and trade names displayed on the Site are the property of their respective owners and may not be used without permission.
10. Prohibited Uses and User Conduct
You agree not to use the Site or our products for any unlawful or prohibited purpose. Without limitation, you must not:
- Violate any applicable law, regulation, or third-party right.
- Submit false, misleading, or fraudulent information, or place fraudulent orders.
- Attempt to gain unauthorized access to the Site, other accounts, or our systems, or interfere with the security or proper functioning of the Site.
- Introduce viruses, malware, or any other harmful code.
- Use bots, scrapers, or automated means to access, collect, or copy content or data without our permission.
- Harass, abuse, threaten, or harm another person, or post content that is defamatory, obscene, or otherwise objectionable.
- Infringe our intellectual property rights or those of any third party.
- Resell or commercially exploit products or content except as expressly permitted by us.
We may investigate any suspected breach and cooperate with law enforcement authorities. We reserve the right to restrict, suspend, or terminate your access to the Site for any conduct that we determine to be in breach of these Terms.
11. Third-Party Links and Services
The Site may contain links to third-party websites, applications, or services that we do not own or control, including payment processors, shipping carriers, and suppliers. We provide these links for convenience only. We are not responsible for the content, policies, products, or practices of any third party, and your use of any third-party site or service is at your own risk and subject to that third party's terms and policies. You should review those terms and policies before engaging with any third party.
12. Feedback and User Submissions
If you send us feedback, suggestions, reviews, ideas, or other materials relating to the Site or our products (together, "Submissions"), you agree that we may use, reproduce, modify, publish, and distribute them for any purpose, without any obligation to compensate you and without restriction, to the extent permitted by law.
- You are solely responsible for any Submission you provide, and you confirm that it does not infringe the rights of any third party or violate any applicable law.
- We are under no obligation to keep any Submission confidential, to pay for it, or to respond to it.
- We may, but are not obliged to, monitor, edit, or remove content that we reasonably consider unlawful, offensive, or in breach of these Terms.
13. Disclaimer of Warranties
The Site and all products and content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that:
- The Site will be uninterrupted, secure, timely, or error-free.
- The information on the Site is accurate, complete, current, or reliable.
- Any products, results, or expectations will meet your requirements.
- Defects will be corrected or that the Site is free of viruses or harmful components.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot be excluded or limited under the laws that apply to you, including any mandatory consumer protection rights.
14. Limitation of Liability
To the maximum extent permitted by law, Ashford & Crowe, Ashford & Crowe, and our directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or in connection with your use of the Site or any product, whether based on contract, tort, negligence, strict liability, or any other legal theory.
To the extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site or a product will not exceed the amount you actually paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you, and this clause does not affect your mandatory statutory rights.
15. Indemnification
You agree to indemnify, defend, and hold harmless Ashford & Crowe, Ashford & Crowe, and our officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with: (a) your breach of these Terms or any policy incorporated by reference; (b) your misuse of the Site or products; or (c) your violation of any law or the rights of any third party.
16. Suspension and Termination
We may suspend, restrict, or terminate your access to the Site or your account at any time, with or without notice, if we reasonably believe that you have breached these Terms, that your conduct may harm us or others, or that suspension or termination is necessary to comply with the law.
- You may stop using the Site at any time and may request closure of your account by contacting us at support@ashfordcrowe.com.
- Termination does not affect any order already accepted, any payment already due, or any right or obligation that by its nature should survive termination.
- Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any other provisions intended to survive will continue to apply after termination.
17. Force Majeure
We will not be liable for any delay in performing, or failure to perform, any of our obligations if the delay or failure results from events beyond our reasonable control. These events may include acts of God, natural disasters, extreme weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes or labour disputes, failures of telecommunications or utilities, government actions or restrictions, and disruptions affecting carriers, suppliers, or payment providers. Where such an event occurs, we will take reasonable steps to limit its effect and to resume performance as soon as reasonably possible.
18. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them, the Site, or your use of it, are governed by and construed in accordance with the laws of your own country of residence.
- You agree that the courts of your own country of residence will have jurisdiction to resolve any dispute, subject to any mandatory consumer rights that entitle you to bring proceedings in your country of residence.
- Before starting formal proceedings, we encourage you to contact us at support@ashfordcrowe.com so we can try to resolve the matter informally and in good faith.
- Nothing in this section limits any statutory rights you may have as a consumer under the laws of your country of residence.
19. Electronic Communications and Notices
When you use the Site, place an order, or send us messages, you consent to receive communications from us electronically, including by email or through notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing, to the extent permitted by law.
- We may send you service-related communications, such as order confirmations, dispatch updates, and important notices about these Terms or our policies.
- You are responsible for keeping the contact details in your account accurate and up to date so that you receive our communications.
- Any notice you send to us should be directed to support@ashfordcrowe.com.
20. Assignment
We may assign, transfer, or delegate our rights and obligations under these Terms, in whole or in part, to any third party, including in connection with a merger, acquisition, reorganization, or sale of assets, without your consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. These Terms are binding on and benefit each party and its permitted successors and assigns.
21. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
22. Entire Agreement and Waiver
These Terms, together with our Privacy Policy, Shipping Policy, Refund and Return Policy, and any other policies or notices published on the Site, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements or understandings. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision, and no waiver will be effective unless made in writing by us. If there is any conflict between these Terms and a specific policy on a particular matter, that specific policy will prevail for that matter.
23. Changes to These Terms
We may update or modify these Terms at any time to reflect changes in our products, practices, or legal requirements. When we make changes, we will update the "Last updated" date and post the revised Terms on the Site with an effective date of August 21, 2026. Changes take effect when posted unless stated otherwise. Your continued use of the Site or placement of an order after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
